Personal Injury and Tort Law

We all have the duty not to injure otherpeople or their property. One who unreasonably causes injury to another's person or property commits a tort (French for "wrong"), and may have to compensate the injured person.

Tort law is the body of law by which persons seek to recover compensation for damage resulting from a personal or property injury.

Not every injury is actionable. Each case turns on its own facts, what duties the law imposes on the person causing the injury, whether there was a violation or "breach" of those duties, whether or not the actions complained of logically caused the injury, whether the injuries were foreseeable, other possible causes of the injury, the damages caused, and whether the injured person could have lessened, or mitigated, the damages by doing things differently after the injury.
